Brazilian Patent and Trademark Office (BPTO) published the second edition of the Industrial Designs Guidelines

The Brazilian Patent and Trademark Office (BPTO) published, in the Industrial Property Gazette 2749 of September 12, 2023, Ordinance No. 36, which establishes the second edition of the Industrial Designs Guidelines.

The publication of the second edition of the Industrial Designs Guidelines is the most recent in a series of actions taken by the BPTO to modernize the protection of industrial designs in Brazil. 

This new edition of the Guidelines aligns the BPTO practices with best international practices, providing Applicants with better predictability when prosecuting industrial design applications in Brazil. 

The use of dashed lines to represent unclaimed parts of an object and the presence of texts and trademarks on objects are, for example, some of the new features in this new edition of the Industrial Designs Guidelines. 

The Guidelines will come into force on October 2, 2023.
